Contempt of court case filed against Finance Minister Khanal for not allowing controversial chairman Ojha to appear before office
Kathmandu. The Supreme Court (SC) has filed a contempt of court case against the government for defying the government’s decision to sack Sharad Ojha, chairman of the Nepal Insurance Authority.
A division bench of Justices Abdul Aziz Musalman and Megh Raj Pokharel on Sunday issued the order to file the contempt of court case after hearing the petition.
Ojha had tried to resume his duties by appearing at the NRA office on the basis of an interim order issued by the court in a case sub judice at the Supreme Court. While the writ petition against him was sub-judice in the court, the Council of Ministers had sacked him from the post on the recommendation of the probe committee. Ojha was sacked from the post of chairman of the NRA on August 17. The court has written to the Ministry of Finance asking it to appear before it for hearing on December 16.
Advocate Indira Dhamala had filed a writ petition at the Supreme Court demanding the removal of Ojha from his post. His qualifications were challenged in the court and the Council of Ministers had sacked him after it was found that his qualifications were not adequate.
Ojha had filed a writ petition at the Supreme Court challenging the decision of the Council of Ministers. After a preliminary hearing on the case, the Supreme Court issued an interim order on September 23, ordering the decision of the Council of Ministers to remain in place. Ojha tried to report to the office on the basis of an interim order, but the government stopped him.
Ojha’s attempt to sit back in the chair failed after the Ministry of Finance directed the NRA not to report to the office on the basis of the court’s interim order. In response to the government’s behavior, Ojha had filed a contempt of court petition claiming that he was contempt of court order of the Supreme Court.
As per Rule 59 of the Supreme Court Regulations, the bench should decide to register the contempt of court case only after hearing the case
