NC’s Khati says Gagan Thapa faction has no legal standing

Makalu Khabar 4 hours ago

KATHMANDU: Nepali Congress Election Committee Coordinator Khamm Bahadur Khati has claimed that the Gagan Thapa faction holds no legal authority regarding the party’s official status and updates.

Visiting the Election Commission on Friday to discuss the party’s official recognition, Khati said that the majority of the Central Working Committee before any dispute determines the party’s name, flag, and symbol.

Speaking to journalists at the Commission, he noted that even some signatories of the special convention have withdrawn their support. Referring to Section 44(b) of the Political Parties Act, 2073, Khati said, “In case of internal party disputes, the majority of the Central Working Committee before the conflict holds the right to the party’s election symbol, name, and flag. We are fully confident in this.”

Khati presented figures showing that 123 of the 167 central committee members support his side.

He accused the faction pushing for a special convention of calling it in violation of party bylaws, without having even 51 percent of the representatives.

Urging the public not to follow misleading propaganda, he expressed confidence that the Election Commission would deliver a fair decision based on the constitution, existing laws, and evidence.

He also argued that using Section 51 under the guise of party updates before the Commission was meaningless. “Any decision or claim made outside the constitution and law is invalid. Media reports are secondary; what matters is what the law says,” Khati emphasized.
